We are committed to ensuring that your personal information is protected and not misused.

In this document we will explain who the data controller of MFLEX DE AUTOMOCIÓN S.L. is, what your personal information will be processed for, the legitimacy for the processing, how we collect it, why we collect it, how we use it, your rights, and we will also explain the processes we have put in place to protect your privacy.

By providing us with your personal information and using our websites, we understand that you have read and understood the terms related to information on personal data protection set out below. At MFLEX DE AUTOMOCIÓN S.L. we assume responsibility for complying with current national and European data protection legislation, and we are committed to processing your data in a lawful, fair and transparent manner.

What will the applicable regulations be?

The European Union adopted the Data Protection Regulation in 2016. Member States must implement it starting from 25 May 2018.

Who is the data controller? 

The natural or legal person who, alone or jointly with others, determines the purposes and means of the processing. The company referring to MFLEX DE AUTOMOCIÓN S.L. will be the data controller of its customers’ personal information.

What are the purposes for which we collect your personal information?

Purposes covered by the contractual relationship:
The main reason why we collect your personal information is because it is necessary to process your request to purchase the vehicle and/or spare parts, to make repairs and, once your request is confirmed, to maintain the contractual relationship.

Other purposes:
Your data may also be used, if you so authorise, to send advertising for other automotive products and services; through all available channels (including electronic media); of a general nature or adapted to your personal characteristics according to your interests, by drawing up a commercial profile based on the information provided and by means of automated processing.

This information may also be used for market research purposes.

What is the legitimate basis for the processing of personal information?

In order to process your personal information, we rely on legitimacy on several grounds:

• To fulfil a contract and/or business relationship.

• With your consent, e.g. to send you personalised offers for automotive products and services.

To whom may we disclose your personal information?

You should be aware that in some cases it may be necessary to disclose your data to third parties who provide services associated with the contract, both to formalise the contract and for its management and execution. In this respect, in order to manage the purposes inherent to the development and fulfilment of the purpose of the contract, it may be necessary and obligatory for the provision of the service, for your data to be disclosed to the various service providers, who will be obliged to use the data solely and exclusively for the purpose of fulfilling the purpose of the contract.

Similarly, MFLEX DE AUTOMOCIÓN S.L. may transfer your data to the manufacturer of your vehicles (and to the group companies of said manufacturer), provided that they are necessary for the execution of the contract. MFLEX DE AUTOMOCIÓN S.L. assumes responsibility for the personal information you provide to us, and we ask those companies with whom we share your personal information to apply the same level of protection of information as we do.

Furthermore, your personal information will be at the disposal of public administrations, judges and courts, in order to address any possible liabilities arising from the processing of your personal information. If you so authorise, your personal data may be transferred to MFLEX DE AUTOMOCIÓN S.L. in order to create commercial profiles by means of automated processing with a view to developing commercial actions adapted to your personal characteristics regarding automotive products and motor vehicle insurance, as well as to carry out market research. Similarly, if you so authorise, your personal data may be transferred to the financial institution whose activity, where applicable, is financing the automotive product that you intend to purchase, in order to create commercial profiles by means of automated processing with a view to developing commercial actions adapted to your personal characteristics and carrying out market research.

International transfer

MFLEX DE AUTOMOCIÓN S.L. may transfer your data internationally, to the manufacturer of your vehicles (and to the group companies of said manufacturer) when it is necessary for the execution of the contract.

If some group companies have a presence in other countries and your personal information is collected in the country in which you reside, we then install and store that information on our systems. Third parties with whom we share your personal information may handle or transfer your personal information outside Spain and the European Union to other countries in which they have facilities. In such a case, they comply with the requirements laid down by the Spanish Data Protection Agency and the European Union.

We will ensure that any transfer of your personal information by us or by third parties with whom we share your personal information, and the way in which we handle your personal information, is in compliance with the laws that apply to us. In any case, the transfer, storage and management of your personal information by us will always be governed by this Privacy Policy.

What are your rights and how can they be exercised?

You have the right to have control over the personal information we collect, thus we also ensure that it is accurate and truthful.

You have the right to obtain access to your personal information, as well as to request the rectification of inaccurate data or, where applicable, to request its erasure when, for instance, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, and for reasons relating to your specific situation, you may object to the processing of your data.

Your personal information will no longer be processed for the purposes to which you have objected.
You may also exercise your right to restrict the processing of your personal information by requesting that we retain it.

In certain circumstances, you may request that your data be transferred to another data controller.

You have the right not to be subject to a decision based solely on automated processing of your data.

You have the right to withdraw your consent.

You may exercise your rights free of charge, and receive a response within the time limits laid down in the data protection legislation in force, by choosing from the following means:

How long do we store your personal information?

We only store your personal information to the extent that we need it in order to use it for the purpose for which it was collected, and pursuant to the legal basis for processing it under applicable law. We will keep your personal information for as long as there is a contractual and/or commercial relationship with you, or as long as you do not exercise your right to erasure, cancellation and/or restriction of the processing of your data.

In such cases, we will keep the information duly blocked, without using it for any purpose, for as long as it may be necessary for the exercise or defence of claims, or as long as any type of legal, judicial or contractual liability may arise from its processing, which must be attended to and for which it may be necessary to recover it.

How do we protect your personal information?

We are committed to protecting your personal information. We declare that we have implemented the necessary technical and organisational measures to guarantee the security of your personal data, preventing its alteration, loss, unauthorised processing and/or access, and these measures are reviewed periodically. We protect your personal information by using a combination of physical, IT and logical security controls, including access controls that restrict and manage how your personal information and personal data is processed, administered and managed.

We also ensure that our employees are suitably trained to protect your personal information.

Additionally, we have taken the following measures to ensure the observance of data protection:

• We have set appropriate security principles.
• We have reviewed the documentation requirements that are necessary to comply with the Regulation.
• We have conducted an assessment of the impact that our procedures may have on the protection of your personal data.

Data of minors

The MFLEX DE AUTOMOCIÓN S.L. website, applications and products are not intended for minors.

If you are a minor, please do not attempt to register as a user of our websites, applications or products. 

If we discover that we have inadvertently obtained personal information from a child, we will delete that information as soon as possible.

Recommendations and precautions

These are some of the precautions we advise our customers to take:

• Do not write them down in easily accessible places: computer, diary.

• Always log out of your browser after you have accessed a security area or after you have entered your username or password into the system.

Amendments to this data protection information

We will review and update the data protection information at least once a year or whenever there are changes to legislation or to any of the procedures for processing your personal information, indicating the date of the last update, content and date.

If we have your email address or phone number, we will also send you an email or SMS with information regarding these changes. If necessary, we will renew your consent for you to confirm that you agree to these changes.
